Since the Suit in question has been dismissed on account of the fact that the application under Order VII Rule 11(d) of the Civil Procedure Code filed by the Defendants was allowed, the challenge to the impugned order at this stage has turned infructuous. In the event, the Suit is restored to file, the Petitioner would be at liberty to renew the challenge to the impugned order. Hence by granting liberty as aforesaid, the Writ Petition is disposed of.
