This application is for restoration of Writ Petition No.10735 of 2015 which was dismissed for default by order dated 29.3.2016.

The learned counsel for the applicant submits that advocate on record for petitioner expired on 11.12.2015 and hence, no one appeared before this court when the matter called out. To that effect, advocate for the applicant is relying on paragraph 3 of Civil Application.

Considering the submissions made by the learned counsel for the Applicant and the averments made in paragraph 3 of the Civil Application, I am satisfied that the Applicant has Mohite 1/2

54 caw1101-16 made out a case for allowing the present Civil Application. Hence, following order:

a) Order dated 29.3.2016 passed by this court is recalled.

b) Writ Petition No.10735 of 2015 is restored on file for hearing on its own merits.
