This is an application for bail in connection with C.R. No. 284 of 2017 registered with Kurar Police Station for the offence punishable under Section 376(2)(i)(m), 418 and 420 of Indian Penal Code. The FIR was lodged on 11th August, 2017. 2.

At the time of lodging the First Information Report, the victim was aged about 18 years. It is alleged that accused had promised her that he is in love with her and willing to marry her. There was physical relationship between them. She had also delivered a child.

During the course of hearing of this application on the earlier occasion, the applicant had filed an affidavit before this Court

stating that he is willing to marry the victim when she has attains the age of majority and he is also willing to take the responsibility of the complainant and the child. In view of that the complainant was impleaded as respondent. However, the complainant was present in the Court on the earlier date of hearing alongwith her father and brother and on instructions from them, learned APP submitted that she is not willing to marry with the applicant. Apparently, it appears that the victim and the applicant were acquainted with each other. There was physical relationship between them. Applicant is in custody since 11th August, 2017. Chargesheet is filed. Further detention of the applicant is not necessary. Hence, I pass the following order.

ORDER

i.

Criminal Bail Application is allowed;

ii.

Applicant is directed to be released on bail in connection with C.R.No.285 of 2018, registered with Kurar Police Station on furnishing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount; iii.

Applicant shall report Kurar Police Station on first Saturday of every month between 10:00 a.m. to 12:00 noon, till further orders;

iv.

Applicant shall attend the dates of hearing before the Trial Court, unless exempted by Court;

v.

Criminal Bail Application stands disposed off. ( PRAKASH D. NAIK, J. )
