By an Order dated 18.4.2018 the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates, to join the process of investigation. 2.

Heard the learned counsel for the applicant and the learned APP. Perused the record of investigation. 3.

The first information report itself mentions that, the fire arm, in question has been seized by the watchman of the said building from accused No.1 Prakash Kamble at the scene of offence itself. There is no question of recovery of alleged stolen property to be the recovery of stolen property at the instance of the applicant.

In view thereof, the interim relief granted by Order dated 18.4.2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
