This application is for bringing legal heirs on record of deceased Appellant original Defendant No.1 Smt. Madhuri Karsandas Chikhal who died on 17/02/2015.

Considering the submissions made by the learned counsel for the Applicant and as the Civil Application is filed within time, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which read thus:

1789.15-caf a) The Applicants be granted liberty to amend the title of the First Appeal as per the schedule annexed hereto.

b) Amendment to be carried out within 8 weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) If amendment is carried out within stipulated time as stated hereinabove, the Applicant is directed to serve an amended copy of the appeal memo on Respondents or their respective Advocates thereafter.

d) Civil application stands disposed off accordingly.
