The prayer in this civil application is for payment of a sum of Rs.60,90,000/- and interest thereon. The claim arises out of difference in the wages paid to the applicant. Mr. Shah states the petitioner has complied with the impugned order. The applicant has been reinstated in service and all back wages computed on the
19-caw-2271-2017 basis of the wages earned by him as on the date of termination of his services have also been paid. Mr. Shah states that the backwages have also been paid on the basis of the wages earned by him at the material time Mr. Shah confirms that the undertaking dated 20 th October, 2006 has been complied with and the dispute is now restricted to the quantum of difference in wages claimed by the applicant and the other permanent workmen in the same cadre. This aspect can be gone into at the hearing of the petition. It is not possible to grant relief sought in this application at the interim stage. In the circumstances, I pass the following order. (i) The petitions are expedited and shall be added to the list of final hearing matters.
(iii) Affidavit in reply, if any, in both these petitions, to be filed within a period of 8 weeks from today. Copy to be served forthwith upon Advocate for the petitioner.
