This is second bail application filed by the applicant/accused before this Court.

The applicant/accused is prosecuted for the offences punishable under Sections 302, 307, 452, 143, 147, 148, 149, 504 of the Indian Penal Code and under Sections 37(1) and 135 of the Mumbai Police Act. 3.

The first bail application was rejected by this Court on 17th January 2017 and the directions were given that if the trial is not commenced on or before 31st January, 2018, then liberty is given to the applicant/accused to move a fresh application and the directions were also given to the learned Sessions Judge to endeavour to expedite the trial. Hence, this is second bail application. Trupti 1/2

Report from the District and Sessions Court, Pune is therefore called in respect of the status of Sessions Case No. 341 of 2015. Registrar (Judicial-I) has submitted report dated 6th October 2018 before this Court and informed that since 6th August 2018 to 9th September 2018, the Court taking up Sessions Case No. 341 of 2015 was vacant. Shri. G.P.Agrawal, District Judge-15 and Additional Sessions Judge is presiding over the said Court. He has framed charge on 5th October 2018.

I am informed by the learned APP, on instructions by the police officer present in the Court, that the matter is fixed before the trial Court on 19 th October 2018.

In view of this, the learned District Judge-15 and Additional Sessions Judge is directed to adhere Section 309 of the Code of Criminal Procedure and take day to day effective hearing of the matter from 19th October 2018. It is to be concluded on or before 31st January, 2019. Parties to co-operate. 7.

Bail Application is disposed of.
