P.C.:- During the course of arguments, upon a query raised by this Court, Mr. More, learned counsel for the Appellants submitted that, the Special Civil Suit No.1880 of 20073 is ready for hearing. That, affidavit of evidence in lieu of examination-in-chief is already filed by the Plaintiff. In view thereof, it will be appropriate to direct the learned Civil Judge, Senior Division, Pune seized of Special Civil Suit No.1880 of 2007 to expedite the hearing of the said Suit and to make an endeavour to dispose it off within a period of one year from the date of receipt of the present 1/2

Till the disposal of the said Suit, impugned Order dated 7th November, 2017 passed below Exhibit 5 in Special Civil Suit No. 1880 of 2007 will remain in operation.

Appeal is disposed off, in the aforesaid terms. In view of disposal of Appeal itself, Civil Application No.483 of 2019 does not survive and is also disposed off. Digitally signed by Sanjiv S.
