Accused No.1 in Special NDPS Case No. 105/2018 has preferred this application, seeking enlargement on bail. I have perused the order dated 11th September, 2019 passed by the Special Judge, under the NDPS Act, Mumbai. Paragraph No. 19 of the order refers to similar but another ofence registered against the applicant and pending case arising therefrom. 1/2

Be that as it may, Mr. Pethe, learned Prosecutor, on instructions, submitted that subject Special NDPS Case No. 105/2018 is ongoing and only fve witnesses are remained to be examined. On instructions, he further submits that in view of the ongoing trial, the bail may not be granted.

In view of the submissions made by the learned Prosecutor, learned Special Judge is requested to conclude the trial in Special NDPS Case No. 105 / 2018 on or before 30th April, 2021. 4.

Application is disposed of in the aforesaid terms. 5.

It is made clear that this Court has not heard the applicant on merits.
