The learned Advocate for the petitioner has vehemently canvassed the grounds set out in this petition. 2.

The learned AGP and the learned counsel representing respondent No.3 submit that a statutory remedy is available to the petitioner in view of the ratio laid down in the matters of Shireen Sami Gadiali & Anr. Vs. Spenta Co-Op.Hsg. Soc. Ltd. & Ors. [2011(3) Mh.L.J. 486] and Haresh Motiram Aswani Vs. The Divisional Joint Registrar Cooperative Societies, Pune Division, Pune & Ors. The learned Advocate for the petitioner, therefore, submits that the petitioner may be permitted to withdraw this petition and avail of the statutory remedy. The time spent before this Court may be considered.
