The order impugned in the present Writ Petition is challenging the order passed by the Custom, Excise and Service Tax Appellate Tribunal. The petitioner has remedy of statutory Appeal under Section 130 of The Customs Act, 1962. 2.

In that view of the matter, Writ Petition is disposed of with liberty to the petitioner to adopt statutory remedy under Section 130 of The Customs Act, 1962.

It is made clear that this Court has not adjudicated the Petition on merits and it would be open for the petitioner to raise all contentions on merits before the Appellate forum. 4.

Writ Petition is disposed of.
