The Applicant is seeking anticipatory bail in connection with C. R. No. 26 of 2023 registered at Daighar Police Station, dated 19/01/2023 u/s. 354-D, 500, 506 r/w. 34 of the Indian Penal Code, u/s. 12, 14 & 15 of the POCSO Act and u/s. 67 of the Information Technology Act.

Heard Mr. Kolte, learned counsel for the Applicant and Ms. Ganapathy, learned APP for the Respondent-State. 3.
This Court (Coram : S. M. Modak, J.) vide order dated 03/05/2023 had granted interim protection to the Applicant. One of the condition was that the Applicant should attend the Daighar police station on every first and third Thursday of every month from akn 1/2

Learned APP on instructions states that the Applicant has not complied with this condition, which is recorded in the order dated 24/08/2023 by another Bench of this Court (Coram: N. J. Jamadar, J.). Learned Counsel for the Applicant at that time had no instructions. The Court had observed that on the next date the Court would be constrained to pass appropriate order. Today, learned Counsel for the Applicant appeared and stated that she has absolutely no instructions from the Applicant. The Applicant has not contacted the Advocate at all. Learned APP reiterated that the Applicant has not attended the police station and has violated the condition. In this view of the matter, no relief can be granted to the Applicant.
