DATE: DECEMBER 6, 2019 P.C.:- 1] This appeal is by the Accused who was convicted for an offence punishable under Section 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988 vide judgment and order dated 3/4/2019.

2] On 30/04/2019, this Court ordered suspension of sentence and release of the Accused on bail.

3] The Accused was initially released on cash bail and was directed to furnish surety which he failed to furnish, as a consequence of which a notice was sought to be served through the Additional Commissioner 1/2

(1) Apeal-604-19.doc of Police Mumbai vide order dated 10/06/2019. 4] During service of the said notice, the Police Authorities having noticed that the Accused has expired on 3/5/2019, his death certificate was collected and copy thereof is produced on record in which it is certified by the competent authority of the Municipal Corporation of Greater Mumbai that the Applicant/Accused is expired on 3/5/2019.

5] In the aforesaid factual background, appeal is ordered to be abated under Section 394 of the Criminal Procedure Code and is accordingly dismissed.
