On 23rd October, 2020 the applicants were admitted to protection from arrest by recording as under:

Admittedly, complainant's civil suit is pending the Court of competent jurisdiction for partition and declaration of his right in Gat No. 376. Admittedly, in the 7/12 extract, note of ' pending suit' is taken. This fact has not been verified by the officials of the State while acquiring the land and paying the compensation to the applicants.

Prima-facie, therefore, a case is made out for granting interim relief to the applicants."

Today, learned APP state that the Investigating officer is not present.

The interim protection granted in favour of the applicants continued for the last two years and by this time, the investigation must be completed.

In the wake of the above, order dated 23rd October, 2020 is made absolute.
