This application by wife is for transfer of M.J.Petition No.A-974 of 2012 from the Family court at Pune to Family court at Nashik Road, Nashik. The proceedings came to be filed by the respondent in the court at Pune, since after the marriage, both the parties resided at Pune and were also working at Pune. The learned advocate for the applicant states that the applicant now desires to resign from her job and go to Nashik to reside with her parents. The application, unfortunately, does not mention this avk 1/2

911-MCA-109-2013 fact. Instead, it states that, the applicant being a housewife has no source of income, and that, she has been residing at Nashik with her parents, since the month of September 2012. As pointed out by the learned advocate for the respondent, both the statements are false to the knowledge of the applicant. The applicant is, infact, an IT Professional, and working at Pune. Since the time of the marital discord, she has been residing in a hostel at Pune. The learned advocate for the applicant states that the applicant now proposes to shift to Nashik, and that, it will be inconvenient for her to travel from Pune to Nashik. The personal inconvenience of travelling of the applicant who is an educated, employed lady who has been residing in a hostel, can hardly be a ground for transfer of the proceedings. In any case, the applicant has made false statements on oath in the application. Hence, the application is dismissed.
