The petitioner's claim that he belongs to Thakar Scheduled Tribe Caste is pending with the respondent No.2 since 2013. The petition is filed seeking direction to the respondent No.2 to decide the said claim expeditiously.

Since the petitioner is seeking innocuous directions to the respondent No.2-Scheduled Tribe Caste Certificate Scrutiny Committee to decide the caste claim, we are inclined to grant the same. The respondent No.2-Scheduled Tribe Caste Certificate Scrutiny Committee, Pune Division is accordingly directed to scrutinize/decide the petitioner's caste claim that he belongs to Thakar Scheduled Tribe as expeditiously as possible and in any case within a period of six months from the date of receipt of this order. The Writ Petition is disposed of. 1/2

It is expressly made clear that we have not gone into the merits of the matter and all rights and contentions of the respective parties are kept expressly open.

The petitioner's claim shall be decided in accordance with law. In order to enable respondent No.2- Scheduled Tribe Caste Certificate Scrutiny Committee to comply this order, the petitioner shall remain present before it on 09.12.2019 at 11.00 a.m. along with copy of this order and the application.

Pending the petitioner's claim that he belongs to Thakar Scheduled Tribe caste before respondent No.2- Scheduled Tribe Caste Certificate Scrutiny Committee, the respondent No.3-Commissioner of Police, Pune City shall not terminate the services of the petitioner on the ground of non submission of the caste validity certificate.
