When this petition was placed before us with a prayer that a direction be issued to the respondents to forthwith release the seized/detained goods, particulars of which are set out in prayer clauses (a) and (b) of the petition, Mr.Walve, learned advocate for respondents on private notice in the presence of Mr.Deepak Pandit, Assistant Commissioner of Customs, states that the seized goods and documents, if any, would be released by 5.30 p.m. today. 2.

In the presence of petitioner's representative the particulars of goods, which are under seizure/detention, would be entered in the document/record made for that purpose and released after such entries. The petitioner's representative shall remain present and duly endorse the document under which the entries are made and release

2 of 2 911.WP.4904.2018 is recorded. This process would commence at 4.00 p.m. today, as stated by Mr.Walve, and by 5.30 p.m. today, the goods shall be released.

When we pass this order we neither absolve the petitioner from any alleged evasion of relevant tax laws nor any other penal consequence that follow from the acts allegedly indulged into by him.
