After the petition was partly argued, both the counsel agree that the Complaint No. NTB-4 of 2003 needs to be remanded to the National Industrial Tribunal for fresh hearing. Therefore, the Writ Petition is allowed in terms of prayer clause (a). The Award dtd. 30th November, 2012 is set aside. Complaint No.NTB-4 of 2003 is remanded to the National Industrial Tribunal, Mumbai for fresh hearing. On it's remand, the Tribunal shall permit the parties to lead additional evidence, if they so desire, including the documentary
