In anticipation of arrest in Crime No.533 of 2021 registered with Panvel City Police Station for the offence punishable under Sections 420, 406, 506 of the Indian Penal Code, the applicant lady seeking for pre-arrest protection.

At the instance of report lodged by one Sanil, the crime was registered against applicant lady and her daughter namely Mamta. It is alleged that though co-accused Mamta had married with someone else in past, she suppressed the said fact and got married with the informant. It is alleged that under one or other pretext co-accused Mamta has extracted near about Rs.10 lakhs from informant. Later on both of them married, however, again applicant and co-accused went to their house and by force taken away all the articles presented in the marriage. The State resisted bail by contending that co-accused Mamta has cheated informant by suppressing earlier marriage as well as after matrimonial dispute again co-accused Mamta has cheated one another fellow by remarrying with him. Prima facie it appears

Priya Soparkar 2 12 aba 1214-22-cr that the allegations are principally against co-accused Mamta about cheating and extorting money. Likewise it is alleged that coaccused Mamta has suppressed her marriages from the informant. The allegations about paying money are also against co-accused Mamta. At the most, applicant's role can be assisting main accused Mamta in such illegal activities. Having regard to these facts, it is appropriate to protect applicant's liberty by directing her to join the course of investigation. In view of that, following order:- (a) The application stands allowed.

(b) In the event of arrest, the Applicant/Accused namely - Laxmi Kishor Patil in Crime No.533 of 2021 registered with Panvel City Police Station for the offence punishable under Sections 420, 406, 506 of the Indian Penal Code, she be released on bail on her furnishing P.R. bond of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall attend the concerned Police Station on every Sunday in between 10.00 a.m. to 12.00 noon till filing of chargesheet.

(d) The applicant/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the prosecution evidence. (e) The application stands disposed in above terms. (VINAY JOSHI, J.) ....
