P.C.:

1) The learned APP on instructions from the Investigating Officer who is present in the Court submitted that in pursuance of Order dated 28.4.2016, the applicant has attended the Investigating Officer, joined the process of investigation and cooperated in the same. He further submitted that in the present crime, the statements of the children of the applicant and complainant Smt. Suman Anil Pandya have been recorded. The son namely Om is about 19 years of age and the daughter Jayali is about 13 years old. He further on instructions submitted that during the course of investigation, the children have expressed their desire to stay with the father i.e. applicant. He further submitted that the custody of the applicant for the purpose of investigation is not necessary to the Investigating Agency.

2) In view of the above, interim relief granted by Order dated 28.4.2016 is hereby confirmed, with modification that the applicant shall attend the Kasturba

Dond 2/2 aba.762-2016.sxw Marg Police Station as and when called for till filing of the chargesheet. 3) It is needless to say that before calling the applicant to the police station, the Investigating Officer shall issue notice under Section 160 of Cr.
