These two Civil Applications are taken out by the Applicant/Petitioners to recall the order dated 22 March 2017 and to allow impleadment of Education Officer, Navi Mumbai Municipal Corporation as Respondent No.5 to the Petitions.

On 22 March 2017, this Court passed the following order:
1. At the request of the learned Counsel for the Petitioner, the Respondent No.4 Education Officer, Zilla Parishad, Thane is allowed to be deleted from the array of the parties and Navi Mumbai Municipal Corporation is allowed to be added as a partyRespondent. Amendment to be carried out within a week.
2. Issue notice to the newly added Respondent after the amendment, returnable on 12 April 2017.

Learned Counsel for the Applicant states that on that day the Counsel inadvertently sought permission to allow the Petitioners to delete the Respondent No.4 instead of seeking permission to add the Education Officer, Navi Mumbai Municipal Corporation. Learned Counsel further points out that so far amendment has not been carried out in pursuance of the order dated 22 March 2017.

In the circumstances, the order dated 22 March 2017 is recalled. The Applications are granted in terms of prayer clauses (b) and (c). Amendment to be carried out within three weeks. Civil Applications to stand disposed of. (A.A.SAYED, J.) Uday.P.Kambli 2/2
