At the outset, learned APP on the instructions of Mr. K. D. Kothimbire, PI, Ghatkopar Police Station makes a statement that identification parade will be held between 15th to 20th May, 2018 and that charge-sheet will be filed on 25.05.2018. 2.

In view of the statement made by the learned APP, learned counsel for the Applicant does not press this Application and seeks leave to withdraw the same with liberty to file a fresh Application, after filing of the charge-sheet, before the appropriate Court. 3.

Accordingly, the Application is disposed of as withdrawn with liberty as prayed.

It is made clear, that if an Application for regular bail is filed, after filing of the charge-sheet, the same shall be considered by the learned Judge, on its own merits, uninfluenced by the withdrawal of this Application.
