DATED : 5th MAY, 2022 P.C:- The Appeal deserve a disposal by a simple direction being issued to the City Civil Court who is seized of a draft Notice of Motion taken out in Special Civil Suit St No.4790/2022.

On perusal of the order which is sought to be assailed in the present Appeal being order dated 26/4/2022, I deem it Tilak

2/2 31 AO 483-22.doc unnecessary to issue any direction at this stage, since by the said order, the learned Judge had deemed it fit to grant an opportunity to the defendants to file their reply before granting ad-interim relief, in the wake of the pending litigation between the parties and some ad-interim order being passed by the High Court. The hearing of the Notice of Motion is slated on 6/5/2022.

Without entering into the merits of the matter and leaving it to the City Civil Judge to abide by his direction dated 26/4/2022, when he shall proceed to consider the grant or refusal of ad-interim relief. On hearing of the concerned parties, the Appeal deserve a disposal and is disposed off accordingly. In view of the disposal of AO, Interim Application No. 3089/22 do not survive and is disposed off.
