Heard. Learned counsel for the applicant, upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice.
2) Learned counsel contends that perusal of papers of investigation would indicate that incident has occurred on the spur of moment. Prima facie it appears that offence committed is under section 326 of Indian Penal Code. However, this is only a prima facie opinion. Learned Magistrate shall consider the application on its own merits without being influenced by the withdrawal of this application as well as orders passed by Sessions Court. ism
