Time is sought on behalf of the petitioners. In substance, the challenge is to the result of the general ward election of Ward No.26-C of the Pune Municipal Corporation on the ground that there was tampering of EVM Machines. There is also a prayer for holding of re-election. There is an efficacious remedy under Section 16 of the Maharashtra Municipal Corporations Act, 1949 for challenging the result of the election. In view of the availability of said remedy, we decline to entertain this petition under Article 226 of the Constitution of India. The petition is disposed of. All contentions on merits are kept open.
