The applicant is seeking bail in Crime No.329 of 2020 registered with D.B. Marg Police Station for the offences punishable under Sections 354-A and 354-D of the Indian Penal Code and under Sections 67 and 67-A of the Information and Technology Act, 2000. 2.
Learned APP opposed the bail on the ground of prima facie involvement.

The investigation in the matter is already over and the charge-sheet is filed. The maximum punishment for the offences is of 5 years. There are no criminal antecedents.

Learned counsel for the applicant submits that the applicant be ordered to be released on cash surety and within four weeks, he will furnish the local sureties. Since the statement is made on instructions, the same is accepted as an undertaking to this Court. Since the applicant is resident of Rajasthan, the assurance given by the learned counsel for the applicant that the applicant shall be attending the trial, is accepted as an undertaking. 6.
In that view of the matter the following order is passed:
O R D E R
(i) The applicant be released on bail in Crime No. 329 of 2020 registered with D.B. Marg Police Station upon furnishing cash surety of Rs.25,000/-, in lieu of solvent surety, which is undertaken to be furnished within eight weeks from today.
(ii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;
3/3 (iii)Two consecutive absence of the applicant during the course of trial and/or his non co-operation in disposal of the trial will entail the Sessions Court to take out the proceedings for cancellation of bail of the applicant.
The application is allowed and stands disposed of in above terms.
