Mr. Saraogi, at the outset, states that the respondent had failed to give 48 hours notice to the applicant prior to his arrest. He submitted that despite the same being urged and raised before the learned Judge, the learned Judge has not dealt with the same. He seeks liberty to withdraw this application with liberty to file an appropriate application before the concerned Judge raising the said ground.

Accordingly, the application is allowed to be withdrawn with liberty as prayed.

Application disposed of accordingly.
