The learned counsel for applicant fairly submits that in the present case, one witness has been examined and the trial is in progress. In view of this, it would not be appropriate to consider an application under Section 439 of Cr.P.C.

The learned Sessions Judge, Greater Bombay seized in Sessions Case No. 819 of 2015 shall not grant unwarranted adjournments to the prosecution. The learned Sessions Court shall make an endeavour to expedite the trial, as early as possible. (SMT. SADHANA S. JADHAV, J.)
