After the matter was heard for sometime learned counsel for the appellant seeks leave to withdraw the draft notice of motion in L.C.Suit No.926 of 2016 on which the impugned order dated 15th April, 2016 being an ad-interim order was passed by the learned Judge, City Civil Court, Dindoshi, Borivali Division, Mumbai. Learned counsel for the appellant states that the Notice of motion was subsequently numbered.

In view of this request to withdraw the Notice of motion filed for interim reliefs, no orders are required to be passed in

Rng 2 this Appeal. Appeal is dismissed as infructuous. Civil Application No. (St.)12713 of 2016 also do not survive and the same is disposed of accordingly.
