1] The affidavit dated 25 January 2017 is presented on behalf of the petitioner. It is recorded in the affidavit that, the petitioner has presented an application under Section 4 of the Maharashtra Settlement of Arrears in Disputes Act, 2016, in October 2016 and has also deposited Rs.1,30,42,976/- towards arrears in terms of settlement. It is further recorded that in view of the settlement arrived at, the present petition rendered infructuous and the petitioner is desirous of withdrawing the petition to enable the designated authority to pass appropriate orders on application tendered by petitioner for recording settlement.
