CORAM : SANDEEP V. MARNE, J.

Dated : 2 APRIL 2024.

P.C. :

1) These applications are fled by the Applicant seeking pre-arrest bail in connection FIR No.I-495/2018 for the ofences punishable under Section 420 read with Section 34 of the Indian Penal Code and FIR No.I-496/2018 for the ofences punishable under Sections 354(b), 420, 406, 323, 504, 506 read with Section 34 of the Indian Penal Code registered with Kolsewadi Police Station.

2) It appears that investigations into the crime are already complete and chargesheets have been fled in both the CRs. The chargesheet however contains an endorsement that the Applicant is absconding and once she is found, a supplementary chargesheet would be fled against her. 3) Mr. Ponda, the learned Senior Advocate appearing for the Applicant would fairly invite my attention to the Order dated 1 April 2021 passed by this Court in the present Applications under which the Applicant had showed willingness to deposit amount of Rs.30,00,000/- in this Court in three equal installments. Mr. Ponda would submit that though the Applicant had showed willingness to deposit the said amount, she is not able to deposit the amount in this Court on account of non-availability of funds. Mr.

Ponda would however submit that since the Investigating Ofcer needs presence of the Applicant for the purpose of fling supplementary chargesheet, the Applicant is willing to remain present before the Investigating Ofcer on the day and time fxed by the Court. Accordingly, the Applicant shall remain present before the Investigating Ofcer on 8 April 2024 at 11.00 a.m. and on such further dates as may be fxed by the Investigating Ofcer. 4) The Applicant is already under interim protection granted by this Court. She has expressed willingness to co-operate with the Investigating Ofcer for completion of investigations and for fling of supplementary chargesheet. In that view of the matter, the Anticipatory Bail Applications can be disposed of by making the interim protection granted in favour of the Applicant absolute.

(i) The Applicant shall remain present before the Investigating Ofcer on 8 April 2024 at 11.00 a.m. and on such further dates as may be fxed by the Investigating Ofcer.

(ii) The Applicant shall attend on dates of hearing before the Magistrate, unless otherwise unexempted.

5) The Anticipatory Bail Applications stand disposed with. Consequently, the Interim Applications fled therein, also stand disposed of. NEETA SHAILESH SAWANT [SANDEEP V. MARNE, J.] NEETA SHAILESH SAWANT Date: 2024.04.04 10:19:43 +0530
