The applicant, who is original accused no. 4, has been convicted under section 302 r/w. 34 of the Indian Penal Code. The applicant is now seeking bail.

Learned APP pointed out that there are two eye witnesses to the incident, i.e., PW-3 Rohan and PW-12 Shridhar. 3.
As far as Rohan is concerned, except for stating that applicant was present, no overt act is attributed to the applicant by Rohan. As far as PW-12 Shridhar is concerned, he does not categorically state that the applicant assaulted the deceased in any manner. In this view of the 1 / 2
11.APPA596_2016.doc matter, we grant bail to the applicant. Hence, the following order: (i) The applicant be released on bail on furnishing P.R. Bond in the sum of Rs.30,000/- with one surety in the like amount. (ii) During the period the applicant is on bail, he shall report to Vishrambag Police Station, Sangli once in a month, i.e., on first Monday of every month.
