2] Considering that the Notice of Motion is dismissed in the year 2015 itself by order dated 26.2.2015, passed by City Civil Court and during the pendency of this appeal no ad-interim relief as such is granted, it would be appropriate that both parties to appear before the trial Court and proceed with the hearing of the suit itself instead of this Court, interfering in the said order, on merits. 3] Hence the Appeal stands disposed off as dismissed. 4] In view of disposal of Appeal itself, pending Civil Application therein becomes infructuous and the same is disposed off accordingly.
