The Learned Counsel for the Appellant states that the suit was filed under the apprehension that the temple would be demolished in the course of widening of the National Highway. He submits that the Highway has been widened and that the temple is not demolished. Hence, under instructions he seeks leave to withdraw the appeal. 2.
