P.C:- Perused the orders passed in ABA No.913 of 2021 and also the order dated 21st May 2021 passed in ABA 1267/21. While admitting the applicants to interim protection, the gist of the accusations is noted and it is also recorded that there is a delay in lodging the FIR for which no explanation is offered. Further, the Court also record that while the entire construction was going on, it do not come to the notice of the informant or anybody, is a Tilak

Further, since the complainant has alleged that the persons who entered in his land, gave their own name and that is how he have named them in the FIR, is also not believed by this Court and in absence of the name of the applicants specifically mentioned, they were already entitled for protection. Since the learned APP state that the applicants were not directed to attend the police station, reserving the liberty to call them for investigation, and as when necessary, interim protection in favour of the applicants is made absolute.
