Coram : A.A.Sayed, J.

Date : 01 February 2017 P.C. :

The Petition under Article 227 of the Constitution essentially challenges the order dated 26 February 2002 of the School Tribunal whereby the Tribunal has cancelled the promotion of the Appellant. The operative part of the impugned order reads as follows: "(1) The appeal is allowed with cost.

(2) The order dated 19.8.2000 by respondent cancelling the promotion of appellant dated 1.2.2000 is hereby declared as illegal hence quashed.

(3) The respondents are directed to promote the appellant as a Head Master in Janata Vidyalaya, Kundalgaon w.e.f. 1.2.2000 with all benefits. (4) The respondents to comply the said order within 2 months and submit reply."

k 2/2 13 wp 2026.02 as.doc Thus the issue involved in the Petition is about promotion. Learned Counsel for the Petitioner has informed the Court that she has no instructions in the matter. Letter dated 18 January 2017 written by the Advocate for the Petitioner is taken on record and marked 'X' for identification.

In light of the above, the Petition is dismissed for nonprosecution. (A.A.Sayed, J.) katkam
