In the order dated 15th November, 2017, it is recorded that the Court was informed that the Petitioner had expired and the legal representatives of the Petitioners were to be brought on record.

Since then, no steps have been taken to bring the legal representatives of the deceased Petitioner on record. 4.

The challenge in this Petition is to the judgment and order 17th March, 2015 in Appeal No.15 of 2015 passed by the learned Member, Maharashtra State Co-operative Appellate Court, Mumbai, afÏrming the judgment and award dated 29th November, 2013 in Dispute No.CC/RGD/101of 2005 passed by the learned SSP 1/2

4 wp 5126 of 2015.doc Judge, Co-operative Court, Raigad/Ratnagiri at Alibag, whereby the deceased Petitioner was directed to pay outstanding amount of Rs.2,89,825, along with further interest @ 18% p.a. from 26th September, 2005 till realization to the disputant Society. 5.

It does not appear that the execution and operation of the impugned judgment and award has been stayed. In view of the above, no fruitful purpose would be served by keeping the Petition alive, as no steps have been taken to bring the legal representatives of the deceased Petitioner on record for almost five years. Hence, the Petition stands disposed.
