Learned counsel appearing for the petitioner, on instructions, of the petitioner, who is present in the Court seeks permission to withdraw this petition so as to avail remedy of appeal before the School Tribunal, however, he submits that the petitioner was prosecuting this petition for one year and while counting period of limitation, said period may be excluded by the School Tribunal, in case the appeal is filed by the petitioner.

The petition is dismissed as withdrawn with liberty to the petitioner to file appeal before the School Tribunal. Needless to observe that while counting period of limitation, the School Tribunal shall keep in view time spent by the petitioner in prosecuting the petition and then pass the appropriate orders.
