2] This petition is directed against the order dated 1 January 2014 made by the Joint Civil Judge, Senior Division, Kalyan directing the petitioner to pay maintenance amounts of Rs.2500/- per month to the respondent, pending the final disposal of Special Civil Suit No. 49 of 2013.

3] There is no dispute that marriage between the petitioner and respondent is subsisting. The petitioner's daughter aged about 2 years resides with the respondent. The petitioner, merely claims that he has left his earlier job as a security guard and consequently he is unable to pay the maintenance. This is not a sufficient ground to deny an interim maintenance.

4] There is no jurisdictional error in making of the impugned order. The petition is accordingly dismissed. There shall be no order as to costs.
