Heard the learned Counsel for the applicant and the learned APP for the State.

This is an application for pre-arrest bail in connection with CR No.288 of 2023, registered with Virar Police Station, Mira-Bhayander, for the offences punishable under Section 420 read with Section 34 of the Indian Penal Code, 1860 ("the Penal Code").

By an order dated 3rd May, 2023 this Court was persuaded to grant protection. It was inter alia noted that another FIR No.238 of 2023 was registered against the husband of the applicant, wherein it was mentioned that the 1/2
47-ABA1189-2023.DOC first informant was cheated in a similar fashion. If that is the matter, the tenability of the second FIR on the same set of allegations is debatable.

The applicant appears to have attended the police station pursuant to the interim order. In any event, having regard to the nature of the accusation the custodial interrogation of the applicant does not seem to be warranted. 5.
The learned APP, however, submits that the applicant has not appeared before the concerned Investigating Officer, though attended the Police Station.

In view of the above, it may be expedient to make the order of interim bail dated 3rd May, 2023 absolute while directing the applicant to appear before the Investigating Officer.

The applicant shall appear before the Investigating Officer on 19th 20th and 21st October, 2023 in between 10.00 am. to 1.00 pm. and, thereafter, as and when directed. 8.
Application stands disposed.
