This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The learned APP submits that the trial has already commenced and prosecution has examined 12 witnesses. 3.

The learned Counsel for the applicants however, submits that applicants are in jail for more than four years. It is submitted that all the prosecution witnesses have turned hostile. Considering the fact that the trial has commenced, I am not inclined to entertain the present application. However, considering the facts and circumstances, the trial Court shall endevour to conclude the trial as early as possible. In case the Kanchan P Dhuri 1 / 2

4-BA-1624-2022.odt trial is not concluded within 4 months from the date of receipt of the copy of this order, the applicants are at liberty to file bail application before the trial Court. If such application is filed, the trial Court shall decide the same within one month from the date of filing of such application. The application is disposed of.
