The Second Appeal is admitted on the substantial question of law. In view of this, pending this appeal the

Rane 2/2 CAS-704-2017 (SR.904) Tuesday, 15.1.2019 decree of the Appellate Court in Regular Civil Appeal No.220 of 2010 dated 24th December, 2010 passed by the District Judge-IV, Thane is hereby stayed and the defendant no.1 is restrained from alienating and/or disturbing and/or parting with the suit Flat. 3.

That pending the hearing and final disposal of the Appeal, the applicants are directed to pay Rs.1,500/- per month as compensation for the user of the suit Flat by depositing it regularly in the trial Court till the disposal of this Appeal. The trial Court is directed to invest the entire amount at its credit deposited by the appellant herein in any nationalised Bank initially for a period of two years and to renew the same till the disposal of this Appeal.
