Learned counsel appearing for the petitioner submits that subsequently after filing this petition, an application was preferred by the wife of the petitioner before the District Judge, Pune for custody of the child Aarya. The said application was entertained and allowed and the custody of child Aarya is given to the wife. The coy of the order passed by the District Court, Pune, is produced on record. Learned counsel for the petitioner submits that due to subsequent events occurred after filing the present petition, the petition has rendered infructuous. The petitioner has already filed the writ petition challenging the order below Exhibit-6 in Criminal Appeal No. 76/2021.

In the light of above, the petition stands disposed of. 3.

We make it clear that we have not considered the contentions raised on merits in the petition and those contentions are kept open, including prayer for production of Child Aarya in the fresh writ petition filed by the Petitioner.
