P.C.:

Heard.

By this petition, the petitioner seeks action against the respondents under the provisions of the Contempt of Courts Act 1971, for willful disobedience of the order dated 14th August 2013 in the Writ petition filed by the petitioner. It is stated that the State Government has failed to decide the proposal of the petitioner for allotment of alternate land within the period of twelve weeks as directed by this Court.

29 CP 555-14 in WP 6017-13.doc Ms Bhende, learned Assistant Government Pleader, has tendered an affidavit in-reply in the Court today. It is stated in the affidavit in-reply that the proposal of the petitioner was rejected as the petitioner had not tendered some necessary documents. It is further stated on behalf of the respondents that since the petitioner has submitted the necessary documents on 23rd May 2014, the respondents would decide the proposal of the petitioner within a period of eight weeks.

By accepting the statement made on behalf of the respondents, we dispose of the Contempt petition, on finding that initially the petitioner had not tendered all the necessary documents along with the proposal.

In the circumstances of the case, no order as to costs. (Mridula Bhatkar J.) (Vasanti A.Naik J.)
