1] This is an application for temporary bail on the ground that the of marriage of the sister of the applicant is to be solemnized on 7th May 2017 at Malad, Mumbai. The invitation card is attached at page No.8 to the application.

2] The learned APP on instructions submitted that the concerned Investigating Officer attached to Malad Police Station, Mumbai has verified the said fact and it is reported that the marriage of the sister of the applicant will be solemnized on 7th May 2017 at Malad, Mumbai. 3] In view thereof, the applicant can be released on temporary

2/2 APPP.389-2017 bail from 5th May 2017 to 9th May 2017 (both days inclusive) in CR No.468 of 2015 registered with Malad Police Station, Mumbai. Hence, the following Order:

(i) The applicant be released on temporary bail from 5th May 2017 to 9th May 2017 (both days inclusive) in CR No.468 of 2015 registered with Malad Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- and cash bail of Rs.25,000/- . The cash bail to be deposited before the Trial Court. The applicant shall be released after 9.00 a.m. on 5th May 2017 and shall surrender before the Jail Authority on or before 5.00 p.m. on 9th May 2017.

(ii) After his surrender to the jail authority within the stipulated period, the applicant shall be entitled to refund of the cash bail amount. The concerned Authority/Court shall refund the cash bail amount to the applicant within 8 days from making such an application. (iii) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
