Heard learned counsel appointed for the applicant. The learned APP, upon instructions, submits that in the present case i.e. Sessions Case No. 49 of 2013, the charge is framed in October 2014. The complainant was examined on 12th July, 2016. It would not be appropriate to consider an application for bail under Section 439 of Cr.P.C. in the midst of the trial and hence the application stands disposed of.

The learned Sessions Judge shall not grant unwarranted adjournments to the prosecution. The learned Sessions Judge shall also see to it that the accused is produced from Jail on each and every date and shall record the evidence as expeditiously as possible.

The learned counsel appointed for the applicant has put in the best of efforts to espouse the cause of the applicant. The professional fees are quantified at Rs.1500/- to be paid to the learned counsel within three months from today. 4.

Office to communicate this order to the applicant, who is lodged in Thane Central Prison and also to the Sessions Court, Dindoshi, forthwith.
