It is an application under Section 439(1)(b) of the Criminal Procedure Code, seeking modification of the bail condition imposed when releasing him on bail. As such, applicant was directed to be released on bail in Crime

2/3 No.129/2018 on furnishing P.R. Bond of Rs.25,000/- with one or two local sureties in the like amount. 2.

Mr. Rathod, learned Counsel for the applicant submits that, in view of the prevailing pandemic of COVID-19, it is difficult to furnish the sureties as directed. It is submitted, the applicant shall arrange for sureties within 45 days from his release from the jail. It is submitted, in these exceptional circumstances, the applicant be directed to be released on provisional cash bail in the sum of Rs.25,000/-. In the consideration of the facts, case is made out, to exercise powers under Section 439(1) (b) and thus, applicant is directed to be released on provisional cash bail in the sum of Rs.25,000/- (Rs. Twenty Five Thousand only) for a limited period of 45 days, from the date of his release from the jail, within which applicant shall furnish surety and comply with the order passed by this Court.

The appellant shall furnish the surety as directed by this Court within 45 days.

It is made clear that, if applicant does not furnish the surety within 45 days, he shall surrender to the concerned Police Station.

It is made clear, no further extension shall be granted for furnishing the surety.

The applicant shall furnish particulars of his contact details and his residential address to the Investigating Officer within a week of his release on provisional cash bail.
