The application which was rejected on 23rd February 2018 is prior to filing of the charge-sheet, whereas now the chargesheet is filed. In view of this, learned counsel for the applicant,upon instructions seeks liberty to approach the Sessions Court under Section 439 of Cr.PC. in

The application stands dismissed as withdrawn. It is made clear that the present application has not been heard on merits. The Sessions Judge shall decide the application on it's own merits.
