DATE: MAY 27, 2021 (VACATION COURT) P.C.:- 1] Applicants are seeking anticipatory bail in CR No. 0058 of 2021 dated 15/3/2021 registered against them for the offences punishable under Sections 353, 427, 504, 506 read with section 34 of the Indian Penal Code.

2] Perused the FIR. The Applicants alongwith other accused not only threatened and deterred the public servants from the Electricity Department, who have visited the house of Ramchandra Jadhav for 1/2

(25) ABA-1296-2021.doc collection of arrears of electricity dues with dire consequences but have also caused damage to the public vehicle. The necessary ingredients of Section 353 are very much satisfied. 3] Apart from above, Applicants are attributed a specific role in commission of crime. Merely because Accused Nos. 2 and 3 are granted ad-interim protection, that by itself will not entitled the Applicants to claim parity, particularly when reasons furnished by the Court in the order granting ad-interim protection in favour of the said Accused, also deals with specific attribution against the Applicants of causing damage to the public vehicle.

4] Apart from above, this Court is not required to appreciate defence of the Applicants at this stage of the proceedings. No case for grant of anticipatory bail is made out. Application for anticipatory bail stands rejected.
