Learned senior counsel Mr.Mohite appearing for the applicant, invites my attention to the order passed by this Court dated 4th June, 2021, by which the applicant came to be released on temporary bail for 21 days, considering the medical emergency. He submits that pursuant to the said order, the applicant has surrendered and is presently incarcerated.

The submission of Mr.Mohite is to the effect that the applicant, who underwent multiple surgeries, still continues to M.M.Salgaonkar

2/2 37 BA-1919-21.doc suffer from severe headache and require immediate medical treatment, in absence of which his health condition will continue to deteriorate. If such is the contingency, the applicant is advised to move an application seeking his release on medical ground. Being given a choice, learned counsel Mr.Mohite states that he does not intend to proceed with the present application on merits, but would fle the separate application on behalf of the applicant, pressing the medical emergency. Liberty is granted to move such an application. 3.

Since I have not touched the merits of the matter and the liberty is granted to seek release of the applicant on medical grounds, the present application stands disposed of reserving the liberty to argue on merits of the matter in case the applicant does not succeed on the ground of medical ailment.
